Bicycles not allowed on tram road

My usual method of getting back to the museum after a C to T or C to C is to lock up my bicycle the day before at the lower tram station and then ride it back to the museum. But today I was stopped by an employee of the tram and was told that bicycles were not allowed on the road due to too many near misses. I would have to walk it down the hill. Has anyone else heard of this new policy?

Do they have the legal right to do that? Is that a public or private road? Seems to me a phone call to the police department is in order to check that information out.

The fact that they close the gate at the bottom of the road every night suggests it's private, not public. But I'm not sure how they could enforce a "no bikes" policy on a private road. Police won't enforce a private property owner's wishes like that. There are some very specific legal steps allowing for the enforcement of the California vehicle code on a private street, but I doubt it would (or even could) include a bike prohibition.

I was witness to one near miss a few months ago. As I was driving up, I was about 3/4 of the way up in a no passing zone. The car in front of me was doing a fairly good speed but it wasn't fast enough for the car behind me. All of a sudden, I see this idiot passing me, JUST AS A BICYCLIST was descending going at a pretty good clip. They came within inches of each other. I think my heart stopped for a second and could not believe what I had just seen. I reported it to the guard station and described the car in question. I did not see the car when I got up to the parking lot but he could have gone in one of the other lots to the left of the main one.

My report may have been a tipping point, I don't know but I don't think they should outlaw bicyclists when clearly, it's the vehicle drivers at fault. Why punish the innocent?

If the tram is really serious about safety on the road, they would do something about the reckless drivers. Some people pass without being able see who is around the corner, and a few people are driving insane speeds because it's a private road with no police monitoring. And I'm not talking about going 10 or 15 mph over the speed limit. The speeds are almost unbelievable.

Perry, i've never encountered those people. Seems i'm always following someone that won't drive above 10 MPH and rides their brakes all the way down.

Maybe they did something about it. It's been awhile since I've been up there. The curb for pedestrians is nice.
